Abstract

In this research I clarified what is related to the criminal right for the heirs in killing case. Also I clarified the concept of allegation and crime and the pillar of allegation. In addition I pointed out what belongs to the heirs' right in case of allegation, and is taking penalty ensured essentially or primary for the heirs or inherited to them. Also I indicated the heirs who deceive rights in jurisprudence and legally and the type of right that heirs allegate it and the court of such issues. Then I talked about the right of heir in case of killing “what kind of killing and what does result for each type and rights of unconscious and absent heir”. Then, I clarified when the allegation got the end and that it ends by the forgiveness of the heirs and I mentioned guidance's from the Islamic law and rules about lawful forgiveness Also I pointed out who has the right to forgive and if just some of heirs forgive does taking penalty fell down. I explained that the allegation ends by money reforming or by lawful command also I mentioned what is related to that all from the penal procedures code. Surely, I was care of collecting all parts of the topic, then I mentioned the conclusion which obtains the summary of and the most important findings then I ended it with an index of sources and references.
