Abstract

The importance of preserving progeny is one of the five necessities maintained by Islam; thus, Islam has legislated the adultery limit to deter people from committing this crime and to preserve the society from corruption and to keep it purified from sins. Due to the tolerance of Islam and the greatness of its justice in investigating the accuracy of adultery, the adultery limit is not accomplished unless it is evident that the offence has been committed. Otherwise, it will be prevented, as with other limits, owing to suspicion because of the rule "suspicions preventing setting the limit". As suspicion nullify the crime and acquit the accused. Sometimes, its verification leads to the prevention of setting the limit and substituting the punishment. This research focusses on identifying legitimate suspicions, and their effect in preventing the adultery limit. Results: The majority of jurists follow "the prevention of setting the limit by suspicion ". However, this principle does not imply not setting the limit on the offender, but sometimes a disciplinary punishment is set by the judge. Setting the limit is usually prevented because of defendants 'retracted confession
