Abstract

The criminal prosecution authorities deal with the accused, either to be caught up in the crime or not to be clothed. In the case of flagrante delicto, the procedures are characterized by a measure of coercion since they are originally investigation proceedings. In contrast to the procedures that are carried out with the accused in cases of flagrante delicto.
The Saudi Criminal Procedure Code authorizes the criminal investigation officers to have exceptional authority in the case of flagrante delicto. In view of the necessity of prompt intervention to preserve the evidence of the crime and to arrest the perpetrators of this crime, The regime also specifies what measures should be taken with the accused against the nature of personal freedom, the conditions necessary to refer him to the investigating authority, the time required for his transfer, and what should be done with the accused in case of not being caught up in the crime and the extent of his arrest and referral The public.
